Terms of Service

These Terms of Service (the "Terms") are an agreement between you and Awobaz Technologies Inc. ("Awobaz", "we", "us"), the company that operates Stocktreats: the website stocktreats.com, its emails and newsletters, and the related services (together, the "Service").

By creating an account, subscribing or otherwise using the Service, you agree to these Terms, to our Privacy Policy and to our Disclaimer. If you subscribe to Premium, the Terms of Subscription apply too. If you don't agree, please don't use the Service.

You must be at least 18 years old, or the age of majority where you live if it is higher, to create an account. You may use the Service only where it is legal for you to do so.

Stocktreats provides general market information and research tools. It does not provide investment, financial, legal or tax advice, and nothing on the Service is a recommendation to buy, sell or hold a security. Data can be delayed or inaccurate. You are solely responsible for your investment decisions and their results. Please read the Disclaimer, which is part of these Terms.

• Give us accurate information, including an email address you can access. We ask you to verify it.
• Keep your password confidential. You are responsible for what happens under your account.
• An account is for one person. Don't share your login or let others use your account.
• Tell us right away if you think someone else has access to your account.

If you sign in with Google, Facebook, X (Twitter) or LinkedIn, you allow us to receive your email address and profile picture from that provider, as explained in the Privacy Policy. Your use of that provider is governed by its own terms.

We may refuse, suspend or close accounts created to abuse free trials, visit limits, referral bonuses or promotions, for example by creating several accounts.

Some features are free. Others require a Premium subscription. Visitors without an account can view a limited number of pages before they're asked to sign up.

New members get a free Premium trial (currently 7 days). The trial doesn't require a payment method and doesn't turn into a paid subscription by itself. From time to time, we may also offer extended trials, referral bonuses or discounts. Their conditions are shown when they are offered, and each is limited to one per person.

We may change or end the free plan, trials and promotions at any time. This never affects a Premium period you have already paid for.

Referrals. When you invite friends from your referral page, we send them an invitation on your behalf. Only invite people you know who would expect to hear from you. We may withhold or remove referral bonuses obtained with fake accounts or by spamming.

Premium is billed in advance every month and renews automatically until you cancel. You can cancel at any time from your account settings, and Premium stays on until the end of the month you paid for. Price, renewal, cancellation and refunds are covered in the Terms of Subscription, which are part of these Terms.

You agree not to:

• scrape, crawl or download the Service's data in bulk, or access it with bots, scripts or other automated means (search engines that follow our robots.txt file are welcome);
• resell, redistribute, republish or sublicense our data, scanner results or content, use them in a commercial product, or use them to build a competing service or dataset or to train AI models;
• share your account or make Premium features or content available to people who don't have access to them;
• get around visit limits, paywalls, rate limits or other security or access measures;
• copy, decompile or reverse engineer the Service's software, except where the law allows it;
• interfere with or overload the Service, introduce malware, or test it for vulnerabilities without our written permission;
• use the Service for anything illegal, including market manipulation, spreading false or misleading information about a security, or breaking securities laws;
• send spam or abusive, threatening or illegal messages through our forms or referral invitations, or impersonate someone else.

Sharing a screenshot or a few results for personal, non-commercial discussion, for example on social media, is fine as long as you credit Stocktreats.

The Service, its software, design and text, the scanner results and compilations, and the Stocktreats name and logo belong to Awobaz or to its licensors, including our market data providers, and are protected by intellectual property laws.

We give you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial purposes, as these Terms allow. All rights not expressly granted are reserved. Our data providers are not liable to you for the data they supply.

The watchlists, portfolios, alerts, settings and messages you create remain yours. You allow us to store, process and display them so we can provide the Service to you.

If you send us ideas or feedback, we may use them freely, without any obligation to you.

The Service relies on, or links to, services run by others: Stripe and PayPal for payments, sign-in providers, StockTwits, news websites and more. Their own terms and privacy policies apply to them. We don't control them and are not responsible for their content, availability or practices.

We send emails needed to run your account: email verification, password resets, the alerts you set up, and notices about your subscription or about these Terms.

With your consent, or where the law otherwise allows it, we also send newsletters, like the weekly market insights, and offers. Every one of these emails has an unsubscribe link. If you don't sign in for a while, we may stop sending you emails.

We keep improving Stocktreats. We may add, change or remove features, scanners, data sources or exchanges, and change what the Free and Premium plans include. We may also interrupt the Service for maintenance or for reasons beyond our control. We don't guarantee that the Service will always be available or free of errors.

If we remove a significant Premium feature, you can cancel your subscription as described in the Terms of Subscription.

You can stop using the Service at any time. You can cancel Premium from your settings and ask us to delete your account through the contact form.

We may suspend or close your account, with notice when it is reasonable to give it, if you break these Terms, if your use creates a risk or legal exposure for us or for others, or if we discontinue the Service. If we discontinue the Service entirely, we will refund the unused part of any Premium period you paid for. If we close your account because you broke these Terms, we don't issue refunds, except where the law requires it.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties and conditions, express or implied, including those of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't warrant that the Service or its data will be accurate, complete, current, uninterrupted or free of errors.

To the fullest extent permitted by law, Awobaz, its directors, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, trading losses, or loss of data or goodwill, arising from your use of, or inability to use, the Service, even if we were told such damages were possible.

To the fullest extent permitted by law, our total liability for any claim related to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the event that gave rise to the claim, and US$100.

To the extent permitted by law, you agree to indemnify Awobaz against claims, losses and reasonable costs, including legal fees, that result from your breach of these Terms or from your misuse of the Service.

Nothing in these Terms limits the rights that consumer protection laws give you and that can't be waived by contract, including under the Québec Consumer Protection Act. Some jurisdictions don't allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the related clauses apply to you only as far as the law allows.

These Terms are governed by the laws of the province of Québec and the federal laws of Canada that apply there. Any dispute will be brought before the courts of the province of Québec, unless the law of the place where you live gives you the right, as a consumer, to bring it before your local courts.

If you have a problem with the Service, please contact us first. Most issues can be solved quickly that way.

• These Terms, together with the documents they refer to, are the entire agreement between you and us about the Service.
• If a clause is found invalid or unenforceable, the rest of the Terms still applies.
• If we don't enforce a clause right away, we don't give up our right to enforce it later.
• You can't transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, an acquisition or a sale of assets, and we will let you know if that happens.
• We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of our providers or of the exchanges.

We may update these Terms. The date at the top of this page shows when they last changed. For a significant change, we will email you at least 30 days before it takes effect, with the new text. If you don't agree with it, you can cancel your subscription and stop using the Service before it takes effect.
